RIDE WAIVER

Please read carefully before signing. This is a release of liability and waiver of certain legal rights.

I realize the NOW Sports, Inc dba. Now Bikes, Tri and Fitness. Rides hereinafter referred to as “The Ride”, requires physical conditioning, and I represent that I am in sound medical condition. I have no physical or medical condition that would endanger either myself or others.

I accept responsibility for the condition of my bicycle and agree to abide by all the rules of The Ride, especially as they relate to the wearing of a helmet.

I understand that bicycling can be HAZARDOUS activity that has many dangers and risks, including injury or death resulting from accident or physical exertion. I understand that bicycling involves a risk of injury, and that injuries are a common and ordinary occurrence of the sport. I agree, as a consideration of, and in consideration for, being permitted to participate in The Ride, to freely and expressly assume and accept any and all risks of injury or death to the rider, or property loss or damage, including injury, death, loss, or damage attributable to negligence of the NOW Sports, Inc dba. Now Bikes, Tri and Fitness.

I agree to release the sponsors and promoters of the The Ride, including NOW Sports, Inc dba. Now Bikes, Tri and Fitness., and other sponsors or affiliated organizations, and their respective agents, directors, officers and employees from any and all responsibility or liability for injuries or damages which result, either directly or otherwise, from my participation in The Ride. I agree not to make a claim against or sue the NOW Sports, Inc dba. Now Bikes, Tri and Fitness, or other sponsors of affiliated organizations for injuries or damages related to bicycling and/or other activities during The Ride.

I am aware that this is a release of liability and a contract between NOW Sports, Inc dba. Now Bikes, Tri and Fitness and me. I am signing it freely and of my own accord and I recognize and agree that it is binding upon myself, my heirs and assigns, and in the event I am signing it on behalf of any minors, I have full legal authority to do so, and realize the binding effect of this contract on them, as well as on myself.

RENTAL AGREEMENT, ASSUMPTION OF RISK, RELEASE & WAIVER

INDEMNIFICATION: The Customer agrees to indemnify and hold harmless NOW Sports, Inc dba. Now Bikes, Tri and Fitness against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from all use and possession by the Customer of the Equipment, including but not limited to any personal injuries sustained as a result of the use of the Equipment by Customer.

In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle or participating in bicycling, I will have no right to make a claim or file a lawsuit against NOW Sports, Inc dba. Now Bikes, Tri and Fitness or its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.

The Customer declares that they have the necessary experience to use the Equipment and that they have tested and checked that the Equipment is in perfect working condition.  The Customer will not allow other persons to use the Equipment.

The Customer agrees to notifiy Now Bikes immediately of any Equipment malfuctions or needed repairs.  Customer declares that the Equipment will not be used improperly and that they will be responisble for the cost of all repairs to the Equipment.
